1. Agreement to Terms

By accessing or using SiteIsDead.dev ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

SiteIsDead.dev provides uptime monitoring services for websites and web applications. Our Service:

• Monitors the availability and response time of your websites
• Sends phone call alerts when downtime is detected
• Provides uptime statistics and incident tracking
• Offers various subscription tiers with different monitoring limits

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account using Google OAuth authentication. You agree to:

• Provide accurate and complete information
• Maintain the security of your account
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Account Termination

Self-Service Deletion: You may delete your account at any time through the Settings menu in your dashboard. Account deletion is permanent and will:

• Immediately cancel any active subscriptions (no refunds for partial periods)
• Permanently delete all monitored sites and incident history
• Remove your account and personal data from our systems
• Cannot be undone - you must create a new account to use the Service again

Termination by Us: We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your account remains inactive for an extended period
• We are required to do so by law

4. Subscription and Payment

4.1 Pricing

Our Service is offered through subscription plans with different features and monitoring limits. Current pricing is displayed on our website and may be changed with 30 days' notice.

4.2 Billing

• Subscriptions are billed monthly in advance
• Payments are processed through Stripe
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method automatically

4.3 Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial months.

5. Acceptable Use

You agree NOT to:

• Monitor websites you don't own or have permission to monitor
• Use the Service to harass, abuse, or harm others
• Attempt to bypass monitoring limits or restrictions
• Reverse engineer or attempt to extract source code
• Use the Service for any illegal purposes
• Overload our systems with excessive requests
• Share your account credentials with others

6. Service Level and Limitations

6.1 Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We are not liable for:

• Scheduled maintenance downtime
• Service interruptions beyond our control
• Delays in alert delivery due to third-party services
• False positives or missed downtime events

6.2 Phone Call Alerts

Phone call alerts are delivered via third-party telephony services. We cannot guarantee:

• Delivery to all phone numbers or countries
• Call quality or connection success
• Immediate delivery during network congestion

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SiteIsDead.dev and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to the data you provide to the Service, including monitored URLs and configuration settings.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• SiteIsDead.dev SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS
• WE ARE NOT RESPONSIBLE FOR LOSSES CAUSED BY MISSED DOWNTIME ALERTS
• WE DO NOT GUARANTEE THE ACCURACY OF MONITORING DATA

You acknowledge that uptime monitoring is a tool to assist you, but you remain solely responsible for maintaining your websites and responding to incidents.

9. Indemnification

You agree to indemnify and hold harmless SiteIsDead.dev, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the Service

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process:

• Account information (email, name from Google OAuth)
• Monitored website URLs and monitoring data
• Phone numbers for alert delivery
• Usage statistics and incident logs

10.1 Cookies and Tracking
